A magistrate or a Judge Must Use the Law and Evidence at all time

One of the authority a magistrate has in his tool kit, is the right to order that a person be evaluated for mental illnesses. However, because of the nature of such evaluation and the stigma that is associated with this it has to be implemented with care.

The ordering of a psychological evaluation should not be done to appease anyone, but it must be done with the best interest of the defendant in mind. Therefore, a magistrate must be very careful in ordering such evaluation and he must also have a systematic plan how such is going to be use, for the betterment of the defendant, the protection of the complainants and the furthering of justice.

The primary purpose for such evaluation to be done is as follows.

1. To see if the defendant is fit to stand trial.

2. To see if the defendant is any real danger to themselves or to anyone else.

3. And to get the defendant help if any such help is needed.

4. And to ensure that the justice system do not perpetrate an injustice to try and convict a person who is unable to properly participate in the process.

My concern with Yugge Farrell is, the charge that she was taken before the magistrate on was a none violent charge which should result in the issuing of a fine less than $100.00. As a matter of fact, police do not get involved in threat unless there is a real chance that there is a mitigating circumstance. In cases of threats the police will locate the defendant and issue a verbal warning and recommend that the complainant take civil actions against the defendant.

It is also important to note, that even though the law give the Magistrate permission to send a person to the mental health asylum, to be evaluated, he do not have the authority to send a person unless he has a justify reason to do so. A justify reason give the Magistrate or Judge the right to act upon his permission or authority.

Evidence is the tool that gives the Magistrate or a Judge the right to act on the authority or the permission that the law gives to them. It is important to note that a Magistrate and or a Judge do not have the authority to make a decision in isolation; but rather, he has a legal obligation to use the law, which gives him the authority to act, with the evidence which give the presiding Jurist the right to act. Each decision with must be a combination of Law and rights – Authority and evidence.

However, the complaint that was made against Yugge Farrell was much less in degree than a threat. When a threat is a person making a promise to do some physical harm or cause death to another, or to damage or to destroy some property, insulting or offensive language is an effort to cause public or private embarrassment to another. Police don’t ever carry such matter before the court.

That is why it is so hard for me to understand the reasoning of the Magistrate to order Young Farrell, be taken into custody and be confined to the mental health facility for two weeks, when any such evaluation can be completed in a few hours with a standardize test. What is the real reason behind this confinement at the Mental Health Center I will like to know?

A young lady by the name of: Yugge Farrell, who appear to be in her teens, came public in an armature home made movie production, and admit to have been involved in a sexual relationship with the current minister of finance of St. Vincent and the Grenadine and elected politician: Camillo Gonsalves. This young lady in her video, accused the son off accused rapist and Prime Minister of St. Vincent and the Grenadine: Ralph E Gonsalves of introducing her to sexual orgies; to be more specific three-somes - which is having group sexual intercourse with three persons

It is important to note that Camillo Gonsalves the minister with responsibility for the ministry that controls the budgeting affairs of the country and the budgetary disbursement of monies for the ministries; is married to Helen Duncan Gonsalves a foreigner. It is also important to mentioned that the junior Gonsalves, is believed to be the beneficiary of political nepotism and his wife are childless.

This is just another of literally hundreds and the latest of political scandals that have rocked the 152 square miles island since the Ralph Gonsalves administration took administrative control of the island affairs over 17 years ago. This government have been implicated in scandals that range from money laundering to the production and distribution of counterfeit monies, from rape and sexual assault to the misuse of public funds for personal use, from the physical abuse of women to violent domestic disputes and an ever growing range of illegalities.

The lady in the video who appear to be a teenager, informed her friends who was the target audience of the video that she was taken to court on abusive language charges, to which she had allegedly issued to Karen Duncan Gonsalves the wife of her ex-boyfriend Camillo Gonsalves. She has alleged to have referred to Mrs. Duncan-Goonsalves as a "Dirty Bitch" a title some Vincentian thinks is fitting for the politicians wife, who is also accused of being a beneficiary of nepotism and have found employment in the ministry of Legal Affairs.

Three years ago the Ralph Gonsalves government passed an oppressive cyber crime bill to silence would be whistle blowers and others who want to truthfully vent as this young lady did. Those who so do ought to be slapped with charges that will see such people sentenced to long prison terms and cjarged unplayable fines. But it seems that not even the cyber Crime bill can protect PM Gonsalves son from the allegation that he has been encouraging the nation's youth and have introduced this teenager into acts of sexual perversion.

It has long believed that Prime Minister Ralph E. Gonsalves and his children only value Vincentian women as a sexual after thought. Prime Minister Ralph Gonsalves who was married a record number of three times and who have never had a serious relationship with a woman from thr country of his birth; only see Vincentian women as a sexual after thought. Like the slave master in the Trans-Atlantic slave trade PM Gonsalves and his sons see Vincentian women as game to be conquered in their sexual exploits even to be raped. The patriarch Gonsalves has a reputation of boasting of his sexual exploits, while on the other hand, the some of the women he was supposed to have had these consensual sexual encounters with accused him (Ralph Gonsalves) of raping them.

It is said where there is smoke there is always more likely than not fire. Let us see if there are anymore such outing of the alleged promiscuous politician: Camillo Gonsalves who was also accused of carrying on several relationship simultaneously with several women two of whom were pregnant with other mens babies. The questions we must find answer to are: were these consensual relation or did Camillo used his family status, political power or other means to persuade these to participate in these sexual acts.
